01. HOME DEL PROYECTO Y PLAZOS DE ENTREGA
The agreed delivery timeline for web design and development starts only once the client has delivered all requested material, including logos, brand guidelines, photos, copy and required access credentials.
Any delay in delivering that material by the client will result in a proportional extension of the final delivery date, without responsibility for the provider.
02. VISUAL CONTENT Y DISEÑO GRÁFICO
The contracted service is limited to web design and development, and does not include visual identity creation or advanced multimedia editing.
- ✦ Logos and Images: The client must provide the logo and photographs in high quality.
- ✦ Additional Services: Logo creation, visual identity design or optimization/enhancement of low-quality images have an additional cost.
- ✦ Billing Criteria: The provider reserves the right to waive these services when appropriate. If they are billed, the client will be formally notified of the additional quote before that work begins.
03. HOSTING AND DOMAIN
- ✦ Hosting: Hosting is offered through external providers. The provider manages the hosting space but does not own the physical infrastructure.
- ✦ Dominio: Domain registration is optional and paid by the client unless otherwise specified in the quote.
04. BACKUPS AND SERVER RESPONSIBILITY
The provider performs periodic backups to protect site information. However:
- ✦ Limitation of Liability: In the event of massive failures, general outages from the infrastructure provider or technical disasters beyond the direct control of the provider, the provider is exempt from responsibility for total or partial data loss. The provider will make the necessary efforts to restore service but does not guarantee third-party infallibility.
05. ABANDONMENT AND CONTINUITY CLAUSE
Project progress depends on fluid communication. Therefore:
- ✦ Inactivity Period: If the client does not deliver the requested material or does not respond to technical questions for more than 20 consecutive days, the project will be considered on hold.
- ✦ Reactivation Fee: To resume an on-hold project, the client must pay a reactivation fee equal to 15% of the original quote value, due to schedule replanning and cost updates.
- ✦ Expiration: After 60 days of total inactivity by the client without prior notice, the provider reserves the right to terminate the service with no obligation to refund deposits or partial payments made.
06. RESPONSIBILITY FOR CLIENT INTERVENTION
Once the website has been delivered and access credentials have been provided:
- ✦ Code Integrity: The provider is not responsible for errors, site downtime or design loss caused by changes made by the client or unauthorized third parties.
- ✦ Repairs: Any technical intervention required to correct errors caused by misuse, incompatible plugin installation or code editing by the client will be quoted as an additional technical service.
07. INTELLECTUAL PROPERTY AND PORTFOLIO
- ✦ Copyright: The final design belongs to the client once 100% of payment has been completed. The provider reserves the right to include a discreet footer signature and use project screenshots in its professional portfolio.
- ✦ Material Warranty: The client guarantees that they own the rights to all delivered material. The provider is exempt from any legal claim related to third-party copyright infringement over that material.
08. ACCEPTANCE OF TERMS
Payment of the initial deposit, contracting the service or sending work material implies full and unconditional acceptance of these Terms and Conditions by the client.
